Employers–Did You Know?

Posting an employment ad seeking the perfect candidate for your company? Make sure you include the salary and job description. There could be penalties if you don’t.

New York State’s pay transparency law was originally enacted on December 21, 2022 and was amended on March 3, 2023. The law went into effect on September 17, 2023.

What does this mean for employers? Covered employers must disclose the compensation (or range of compensation) in an ad for a covered job, promotion, or transfer opportunity and they must also include a job description in the ad (if it exists).

It also applies to jobs that will physically be performed at least in partly in New York, as well as jobs that will physically be performed outside of New York but report to a manager office, or other work location in New York. As originally written, the law did not clarify whether it covered remote or hybrid work.
